1. INTRODUCTION

These Terms & Conditions (“Terms”) govern your access to and use of the Diet Different mobile application, the Diet Different pages and forms available at www.diet-different.com, and related support services collectively referred to as the “Service”.

The Service is operated by Owen Matthew Dunderdale and Cherise Dunderdale, trading in partnership as Diet Different (“Diet Different”, “we”, “us” or “our”).

These Terms relate specifically to Diet Different and do not govern separately purchased personalised online-coaching services unless expressly stated.

By creating an account, selecting the acceptance checkbox, purchasing a subscription or using the Service, you confirm that you have read and agreed to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not create an account, purchase a subscription or use the Service.

Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded under the South African Consumer Protection Act 68 of 2008 or other applicable consumer-protection laws.

2. ELIGIBILITY

Diet Different is intended only for people who are 18 years of age or older.

People under 18 may not create an account, purchase a subscription or use the Service. By using Diet Different, you confirm that you are at least 18 years old and legally capable of entering into this agreement.

If we reasonably believe that an account belongs to someone under 18, we may suspend or close the account and delete the associated personal information in accordance with our Privacy Policy.

3. THE DIET DIFFERENT SERVICE

Depending on the version of the App and your active subscription, Diet Different may provide access to:

• Recipes and nutritional information

• Meal-planning tools

• Shopping-list features

• Calorie and nutrition calculators

• Nutrition-goal settings

• Food Library information and adjustable food-quantity tracking

• Optional healthy-habit and water-intake tracking

• Weekly planner progress, trophies, consistency streaks, personal bests and badges

• Progress-monitoring tools

• Takeout and restaurant-menu information

• Educational nutrition content

• Sponsored-partner information and external links

• Account and subscription-management features

Diet Different is a self-guided digital service. Your subscription does not include personalised coaching, individual meal-plan preparation, a dietetic consultation, individual medical assessment or ongoing communication with a dietitian.

We may improve, replace, update or discontinue individual features when reasonably necessary. We will take reasonable steps to avoid materially reducing the overall value of an active paid subscription and will provide notice where required by law.

4. ACCOUNTS AND LOGIN SECURITY

You must provide accurate and current information when creating and maintaining your account.

You may sign in using an email login code, Sign in with Apple or Google authentication. Diet Different does not require or store an account password.

You are responsible for:

• Maintaining access to your registered email account

• Protecting your devices and login verification codes

• Ensuring that your account information remains accurate

• Not allowing another person to access or use your account

• Notifying us promptly if you suspect unauthorised access

Your account is personal to you and may not be sold, transferred, rented or shared.

We may apply reasonable device, session and security limits to protect accounts and prevent unauthorised account sharing. We may require you to verify your identity or sign in again when necessary.

Never send your password or login verification code through a support message or website form.

5. SUBSCRIPTIONS AND PAYMENT

Access to the paid features of Diet Different requires an active subscription.

Monthly and annual subscription options may be offered. The exact price, currency, billing period, applicable taxes and subscription terms will be displayed in the Apple App Store or Google Play purchase screen before you confirm your purchase.

Prices may differ between countries because of local pricing, currency conversion, taxes and platform pricing arrangements.

Subscriptions are purchased and processed only through:

• The Apple App Store for iOS purchases

• Google Play for Android purchases

Apple or Google will charge the payment method connected to your applicable store account. Diet Different does not receive your complete bank-card or bank-account details.

RevenueCat assists us with validating purchases and determining whether an account has an active subscription entitlement.

Unless the purchase screen expressly states otherwise, subscriptions automatically renew for the same subscription period until cancelled. Your store account will be charged at the applicable renewal price in accordance with Apple’s or Google’s billing rules.

We currently do not offer a free trial. If a free trial or promotional offer is introduced, its duration, eligibility, price after the promotional period and renewal conditions will be displayed before purchase.

You can use the “Restore Purchases” function where available to restore an eligible subscription purchased through the same Apple or Google account.

6. CANCELLING A SUBSCRIPTION

You can manage or cancel your subscription through the subscription settings of the platform through which it was purchased:

• Apple subscriptions must be managed through your Apple ID subscription settings.

• Google Play subscriptions must be managed through your Google Play subscription settings.

Cancellation normally prevents the next automatic renewal. Unless the platform indicates otherwise, you will continue to have access until the end of the subscription period for which payment has already been made.

For Apple subscriptions, cancellation should be completed at least 24 hours before the current subscription period ends to avoid the next renewal, subject to Apple’s applicable rules.

Deleting the Diet Different App from your device does not cancel your subscription.

Deleting your Diet Different account does not cancel your subscription.

Cancelling your subscription does not automatically delete your Diet Different account or previously saved information.

If you want both your subscription and your account to end, you must cancel the subscription through Apple or Google and separately request deletion of your Diet Different account.

Access may end if a payment fails, is reversed or is not successfully renewed by the relevant platform.

7. REFUNDS

Payments and refund requests are administered by Apple or Google under their respective rules and applicable law.

If you purchased through the Apple App Store, refund requests must ordinarily be submitted to Apple. If you purchased through Google Play, refund requests must ordinarily be submitted through Google Play.

Diet Different cannot directly reverse or refund a payment collected by Apple or Google unless the relevant platform provides a mechanism allowing us to do so.

Cancellation does not ordinarily result in a refund for a subscription period that has already begun, except where a refund is required under applicable law or granted under the relevant platform’s policies.

Nothing in these Terms limits any refund, cooling-off, cancellation or other consumer right that applies to you by law.

8. HEALTH AND NUTRITION DISCLAIMER

Diet Different provides general educational information and self-guided nutrition tools. It is not a medical service and is not intended to diagnose, treat, cure or prevent any illness, injury, eating disorder or medical condition.

Although nutrition content may be created or reviewed by a Registered Dietitian, use of the App does not establish a dietitian-client, healthcare-professional–patient or other professional-treatment relationship.

The Service does not replace an individual medical, dietetic or psychological assessment. You should consult an appropriately qualified healthcare professional before making material changes to your diet, particularly if you:

• Have a medical condition

• Take prescription medication

• Have food allergies or intolerances

• Are pregnant, trying to become pregnant or breastfeeding

• Have a current or previous eating disorder or disordered-eating history

• Have unusual symptoms or concerns about your health

Diet Different does not currently collect pregnancy status. The absence of a pregnancy question does not mean that the App’s calculations or recommendations are suitable during pregnancy or breastfeeding.

If you have a current or previous eating disorder, calorie and body-measurement tools may not be appropriate for you. Please seek guidance from an appropriately qualified healthcare professional.

Diet Different is not an emergency service. If you believe that you are experiencing a medical emergency, contact your local emergency services or seek immediate medical assistance.

Individual results vary. We do not guarantee weight loss, muscle gain, improved health, improved performance or any other particular outcome.

9. CALCULATORS, PROGRESS FEATURES AND NUTRITIONAL ESTIMATES

Calorie, macronutrient, body-composition and activity calculations are estimates generated from the information you enter and general mathematical formulas.

Actual nutritional needs can differ because of health status, metabolism, activity, medication, pregnancy, breastfeeding, measurement error and other individual factors.

Calculator results are provided for general informational purposes and should not be treated as a diagnosis, prescription or personalised dietetic recommendation.

If you save or apply a calculator result, the resulting estimated calorie and macronutrient targets may be stored in your account as your nutrition goals and used by relevant App features. These targets remain automated estimates and are not medical advice, a diagnosis, a dietetic consultation or a personalised medical nutrition prescription.

You are responsible for checking that the information you enter is accurate and for deciding whether a calculated target is appropriate for you.

Nutritional values calculated from Food Library items depend on the reference quantity, serving unit and quantity selected. These values are estimates and may be affected by rounding, incomplete manufacturer information or differences between the listed food and the product consumed.

Planner-completion percentages, trophies, consistency streaks, personal bests and badges are automated motivational features generated from activity recorded in the App. They are not medical assessments, guarantees of progress or confirmation that a particular behaviour is appropriate for your individual circumstances.

10. RECIPES, FOOD LIBRARY, ALLERGENS AND FOOD SAFETY

Recipe and Food Library ingredients, product descriptions, quantities, serving sizes, cooking times and nutritional values are estimates and may vary according to the products, brands, preparation methods and portion sizes used. Food Library information may be compiled from manufacturer labels, retailer information, public food-composition data or other available sources and may contain rounding, omissions, discrepancies or outdated information.

You are responsible for:

• Checking ingredient labels

• Avoiding ingredients that are unsuitable for you

• Managing food allergies and intolerances

• Following appropriate food-safety practices

• Ensuring that food is stored and cooked safely

• Seeking professional advice where medically necessary

An ingredient filter, recipe description or absence of a listed allergen is not a guarantee that a recipe is free from a particular allergen or suitable for a medical condition.

Diet Different is not responsible for manufacturing changes, undeclared allergens, cross-contamination or incorrect information supplied by food manufacturers, retailers or restaurants.

11. TAKEOUT AND RESTAURANT INFORMATION

Restaurant names, product names, menu descriptions, serving sizes, ingredients, nutritional values and other takeout information may be compiled from information published or otherwise made publicly available by the relevant restaurant, retailer or brand.

Diet Different does not independently laboratory-test, prepare or weigh restaurant products. Nutritional values shown in the App should therefore be treated as estimates and not as guaranteed values for the particular meal you receive.

Actual portions and nutritional values may differ because restaurant meals are prepared in real-world environments and may be affected by differences in ingredient quantities, product sizes, manufacturing, cooking methods, oil absorption, sauces, toppings, substitutions and staff preparation. Restaurant staff may not weigh every ingredient or portion individually.

Published restaurant information may also contain rounding, omissions, errors or inconsistencies, and menus, ingredients, recipes, prices, serving sizes and nutritional values may change without notice. Information displayed in the App may therefore differ from a restaurant’s current published information or from the product served to you.

Diet Different takes reasonable care when compiling and presenting takeout information but does not guarantee that every restaurant entry will always be complete, current or free from discrepancy.

You should confirm important nutritional, ingredient and allergen information directly with the relevant restaurant before ordering or consuming a product. Takeout information should not be relied upon where exact nutritional or allergen information is medically necessary.

References to a restaurant, retailer or brand do not imply sponsorship, endorsement or affiliation unless we clearly state otherwise.

All restaurant and brand names and trademarks remain the property of their respective owners.

12. SPONSORED CONTENT AND THIRD-PARTY LINKS

Diet Different may display clearly identified sponsored-partner content, offers, discount codes or links, including content associated with Biogen.

Diet Different may receive payment or another commercial benefit in connection with sponsored content.

Sponsored content does not mean that a product is appropriate for every person. You remain responsible for checking product ingredients, warnings and suitability and for obtaining professional advice where necessary.

Opening a third-party link takes you away from Diet Different. Any purchase, communication or interaction with the third party is governed by that party’s own terms, privacy policy, delivery conditions and refund rules.

We do not control and cannot guarantee the continued availability, price, accuracy or performance of a third-party website, product, offer or discount code.

Merely viewing a sponsored offer in Diet Different does not provide the partner with access to your Diet Different account information.

13. INTELLECTUAL PROPERTY AND APP LICENCE

The App, its design, software, branding, databases, original text, original recipes, images, graphics and other Diet Different content are owned by or licensed to Diet Different and are protected by applicable intellectual-property laws.

While you comply with these Terms and maintain any subscription required for access, Diet Different grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App and its content for your own lawful, non-commercial purposes.

You may not, without our prior written permission:

• Reproduce or republish substantial portions of the App or its content

• Sell, sublicense, distribute or commercially exploit App content

• Scrape, harvest or systematically extract recipes, images or data

• Circumvent subscription, authentication or security controls

• Reverse engineer or attempt to obtain the App’s source code, except where applicable law expressly permits it

• Remove copyright, trademark or ownership notices

• Use Diet Different branding in a misleading or unauthorised manner

• Present Diet Different content as your own work

You may keep reasonable personal notes or shopping lists created through your lawful use of the Service.

14. ACCEPTABLE USE

You must not use the Service:

• For any unlawful, fraudulent or abusive purpose

• To gain unauthorised access to another person’s account

• To share, sell or transfer account access

• To interfere with the operation or security of the Service

• To introduce malicious code or perform automated attacks

• To test or probe security without written permission

• To collect information about other users

• To infringe another person’s intellectual-property or privacy rights

• To misrepresent your identity or relationship with Diet Different

• In a way that places an unreasonable burden on the Service

 

15. SUSPENSION AND TERMINATION

You may stop using Diet Different at any time, subject to separately cancelling any active subscription.

We may restrict, suspend or close an account where we reasonably believe:

• These Terms have been materially or repeatedly violated

• The account is being shared or used without authorisation

• Fraud, payment abuse or unlawful activity is occurring

• The account presents a security risk

• Suspension or closure is required by law or a platform provider

• The user is under 18

Where reasonably possible, we will provide notice and an opportunity to correct the issue. Immediate action may be taken where necessary to protect users, the Service or third parties.

Suspension or closure of a Diet Different account does not automatically cancel an Apple or Google subscription. You remain responsible for cancelling the subscription through the relevant platform.

Any refund following suspension or termination will be determined in accordance with applicable law and the relevant store’s policies.

Provisions concerning intellectual property, liability, disputes and other matters that reasonably need to continue will survive termination.

16. PRIVACY AND ACCOUNT DELETION

You can initiate permanent account deletion inside the App by following:

If you cannot access the App, you can submit an account-deletion request at:

We will verify account ownership before processing a website request.

Account deletion is permanent. Once completed, the deleted account and associated user information cannot be restored.

Certain information may be anonymised or retained where reasonably necessary for legal, tax, accounting, fraud-prevention, security, audit or dispute-resolution purposes, as explained in our Privacy Policy.

Account deletion does not cancel an Apple App Store or Google Play subscription. You must cancel the subscription separately through the relevant platform.

17. SERVICE AVAILABILITY AND UPDATES

Diet Different requires a compatible device, suitable software and an internet connection. You are responsible for your device, mobile-data charges and internet access.

We aim to provide a reliable Service but do not guarantee that it will always be uninterrupted, error-free or available on every device.

Temporary interruptions may occur because of maintenance, updates, internet failures, hosting failures, store-platform issues, security incidents or circumstances outside our reasonable control.

We may release updates that correct errors, improve security, introduce features or maintain compatibility. Some updates may be required for continued use.

We may correct obvious content, pricing or technical errors. A pricing correction will not retrospectively increase a completed charge without the process or consent required by the relevant platform and applicable law.

18. APPLE AND GOOGLE PLATFORM TERMS

These Terms are between you and Diet Different, not Apple or Google.

For an iOS version of the App:

• Apple is not responsible for the App or its content.

• Diet Different, and not Apple, is responsible for providing maintenance and support for the App.

• Your licence is limited to using the App on Apple-branded products that you own or control, as permitted by Apple’s applicable usage rules.

• Diet Different is responsible for addressing claims relating to the App, including product, regulatory, consumer-protection and intellectual-property claims, subject to applicable law.

• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions applicable to them.

• Apple’s standard Licensed Application End User License Agreement and applicable App Store terms also apply.

For an Android version of the App:

• Google is not responsible for the App or its content.

• Google Play’s applicable terms govern the operation of Google Play, store billing, subscription administration and platform refund processes.

• Diet Different remains responsible for the App and the support it provides, subject to these Terms and applicable law.

You must comply with all applicable third-party terms when using the App, including the terms governing your device, Apple ID, Google account and internet service.

You may not use or export the App in violation of applicable sanctions, export-control or other laws.

19. DISCLAIMERS AND LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful. This includes any liability or consumer right that cannot be excluded under applicable consumer-protection legislation.

To the extent permitted by law:

• The Service is provided on an “as available” basis.

• We do not guarantee that all content will always be complete, current or free from error.

• We do not guarantee that use of the Service will produce a particular health, weight, appearance or performance outcome.

• Diet Different is not responsible for decisions made solely in reliance on general App content where individual professional advice should reasonably have been obtained.

• Diet Different is not responsible for the acts, omissions, products, services or systems of independent restaurants, manufacturers, sponsors, app stores or external websites.

• Diet Different will not be liable for indirect or consequential loss that was not reasonably foreseeable when you agreed to these Terms.

Nothing in these Terms excludes liability for fraud, wilful misconduct or gross negligence, or any other liability that cannot legally be excluded.

You are responsible for losses reasonably resulting from your unlawful use of the Service, deliberate violation of these Terms or infringement of another person’s rights.

20. ESSENTIAL COMMUNICATIONS

We may send essential communications concerning login codes, account security, subscription access, policy changes, support requests or account deletion.

These are service communications and are not promotional marketing.

Diet Different does not currently send promotional emails or push-notification marketing. If optional marketing is introduced, it will be managed in accordance with applicable consent and opt-out requirements.

21. CHANGES TO THESE TERMS

We may update these Terms when the Service, features, technology, providers, platform requirements or applicable laws change.

The revised Terms will be made available in the App and on this website with an updated “Last updated” date.

Where a change materially affects your rights or use of the Service, we will provide reasonable notice where required.

Changes will not retrospectively alter a completed payment or remove rights that have already arisen under applicable law.

If you do not agree to revised Terms, you may stop using the Service and cancel your subscription before its next renewal.

22. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of South Africa.

If a dispute arises, please contact us first so that we can attempt to resolve it in good faith.

If the dispute cannot be resolved informally, either party may use any court, tribunal, regulator, consumer-protection body or dispute-resolution process that has lawful jurisdiction.

Nothing in these Terms prevents you from exercising mandatory consumer rights or approaching an appropriate regulator or court.

If you use Diet Different outside South Africa, any mandatory consumer rights applicable in your country or region remain unaffected to the extent required by law.

23. GENERAL TERMS

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

A delay or failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your account or your rights under these Terms without our written permission.

We may transfer the operation of the Service or our rights and obligations as part of a lawful restructuring or transfer of the business, subject to applicable law and appropriate protection of personal information.

These Terms, the Privacy Policy, the subscription information shown at purchase and applicable Apple or Google platform terms constitute the agreements governing your use of Diet Different.

If store-platform terms conflict with these Terms on a matter controlled by the platform, such as payment processing or platform refunds, the applicable platform terms will govern that matter. Mandatory law always prevails.
