1. Introduction

This Privacy Policy explains how Diet Different collects, uses, stores, shares and protects personal information when you use the Diet Different mobile application, the Diet Different pages and forms available at www.diet-different.com, and related support services.

The responsible party is Owen Matthew Dunderdale and Cherise Dunderdale, trading in partnership as Diet Different (“Diet Different”, “we”, “us” or “our”).

This Policy relates specifically to Diet Different and does not govern separate personalised online coaching services unless expressly stated.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and other applicable privacy laws.

2. Eligibility

Diet Different is intended only for people who are 18 years of age or older.

People under 18 may not create an account or use the App. We do not knowingly collect personal information from children. If we discover that an account belongs to someone under 18, we may close the account and delete the associated personal information.

3. Information you provide

Depending on the features you use, you may provide the following information:

Account and identity information

• First name and surname

• Email address

• Age in completed years

• Sex selection

• Legal-policy acceptance records and timestamps

We collect your age rather than your full date of birth.

Nutrition and body information

• Height

• Weight

• Calorie and macronutrient goals

• Nutrition-goal settings

• Meal-planner entries, including selected recipes, takeout items and Food Library items

• Food quantities, serving units and calculated nutritional values saved to your meal plan

• Optional healthy-habit records, including water intake and whether you record completing your step, exercise and bedtime goals

• Planner-completion percentages, consistency streaks, personal-best streaks and badges generated from your recorded activity

• Optional progress check-ins, including check-in dates and recorded body weight

• Optional body measurements, including waist, hips, chest, thigh and arm measurements

• Optional notes added to progress check-ins

Some of this information may constitute health-related or special personal information under applicable law. We use it only to provide the features you request, calculate estimates and allow you to monitor your own progress.

When you use the calorie calculator, Diet Different uses information including your age, sex, height, weight, activity level and, if provided, body-fat percentage to calculate estimated daily calorie and macronutrient targets. Your age, sex, height and weight are stored as part of your account profile. If you save or apply the calculation, the resulting calorie, protein, carbohydrate, fat and fibre targets are stored in your account as your nutrition goals so that they can be displayed and used by relevant App features. Activity level and body-fat percentage are used to perform the calculation but are not currently stored in your account profile.

When you use the meal planner, Diet Different may store the foods, recipes or takeout items you select, the quantities and serving units you enter, and the associated nutritional values used to calculate your daily totals. If you use the healthy-habit and consistency features, we store the activity you record and use it to calculate weekly completion, streaks, personal bests and earned badges. These features depend on information you choose to record and are intended to help you monitor your own routines and progress.

Support and deletion requests

When you contact support or submit the website account-deletion form, we may collect:

• Your first name and surname

• Your email address

• Information included in your message

• Your deletion confirmations

• Correspondence required to verify and process your request

Never provide your password, login verification code or unnecessary sensitive information through a website form or support message.

4. Information received from authentication and payment providers

You may sign in using an email login code, Sign in with Apple or Google authentication.

Depending on the method you choose, we may receive:

• Your verified email address

• Your name

• An Apple or Google account identifier

• A Google profile-picture URL, if Google provides one

• Information required to authenticate your account securely

Diet Different does not collect or store account passwords.

Subscriptions are purchased through the Apple App Store or Google Play. Apple and Google process your payment details under their own privacy policies. Diet Different does not receive your complete bank-card or bank-account details.

We may receive and store limited subscription information, including:

• The subscription product selected

• Subscription status

• Purchase, renewal and expiry information

• Entitlement status

• Store transaction or receipt information

• Whether a subscription is expected to renew

RevenueCat helps us validate purchases and manage subscription access. RevenueCat receives an internal user identifier, product information and store receipt or entitlement information.

5. Information collected automatically

When you use Diet Different, we may automatically collect limited technical and security information, including:

• Internet Protocol address

• Device or browser information

• User-agent information

• A technical device fingerprint

• Login dates and authentication events

• Session and security information

• Failed login or verification events

• App requests and server diagnostic information

This information is used to authenticate users, maintain sessions, enforce security controls, investigate misuse and protect Diet Different and its users.

The App does not currently use third-party advertising identifiers, behavioural advertising SDKs or third-party app analytics and crash-reporting SDKs.

6. Website cookies and analytics

The Diet Different website is hosted through Wix. Wix may use essential, functional and analytics cookies or similar technologies to operate the website, remember settings, protect forms and provide website-traffic information.

The secure web version of Diet Different may also use an essential session cookie to keep a user signed in. This cookie is not used for advertising.

Where required, non-essential website cookies will be subject to appropriate consent controls. You can also restrict or delete cookies through your browser settings, although disabling essential cookies may prevent certain website features from working correctly.

The mobile App does not use advertising cookies.

7. How we use personal information

We process personal information to:

• Create, authenticate and manage your account

• Provide access to recipes, the meal planner, shopping-list features, nutrition calculators, progress tools and takeout information

• Calculate and save nutrition goals

• Display your saved information and progress

• Calculate estimated nutritional totals from foods, serving sizes and quantities added to your meal plan

• Record optional water, step-goal, exercise and bedtime-goal activity

• Calculate and display weekly planner completion, consistency streaks, personal bests, trophies and badges

• Validate subscriptions and manage paid access

• Restore purchases

• Send essential login codes and account-related communications

• Respond to support and privacy requests

• Verify and process account-deletion requests

• Maintain account and service security

• Detect fraud, account misuse and unauthorised account sharing

• Maintain legal and consent records

• Comply with tax, accounting, regulatory and legal obligations

• Investigate complaints or disputes

• Maintain and improve the reliability of the service

We do not currently send promotional emails or push-notification marketing. If marketing communications are introduced in the future, they will be handled in accordance with applicable consent and opt-out requirements.

8. Lawful grounds for processing

Depending on the circumstances, we process personal information:

• With your consent

• To create and perform our agreement with you

• To provide features you have requested

• To comply with a legal obligation

• To protect your legitimate interests or the legitimate interests of Diet Different and its users

• To establish, exercise or defend legal claims

Where consent is relied upon, you may withdraw it. Withdrawing consent does not affect processing that was lawful before withdrawal. Certain information remains necessary to provide an account or a requested service.

9. Service providers and disclosures

We may provide limited personal information to service providers that help us operate Diet Different, including:

• MongoDB Atlas, for application database hosting

• RevenueCat, for subscription verification and entitlement management

• Apple, for Sign in with Apple and App Store subscriptions

• Google, for Google authentication, Google Play subscriptions and transactional-email delivery

• Expo and Emergent, for application development, delivery and hosting

• Wix, for website hosting, website forms, deletion requests and website analytics

• Cloudflare, for delivery and storage of recipe and takeout images

Cloudflare image storage is used for app content managed by Diet Different and not for ordinary user-uploaded profile photographs.

We may also disclose information:

• To professional advisers where reasonably necessary

• To regulators, courts or law-enforcement authorities where required by law

• To investigate fraud, abuse, security threats or unlawful activity

• To protect the rights, safety and property of Diet Different, its users or others

• In connection with a lawful restructuring or transfer of the service, subject to appropriate privacy safeguards

Service providers are expected to process information only for authorised purposes and apply appropriate protection.

10. International processing

Some service providers may process or store information outside South Africa.

Where personal information is transferred internationally, we take reasonable steps to use providers and safeguards that provide an appropriate level of protection in accordance with POPIA and applicable law.

11. Sponsored and third-party links

Diet Different may display clearly identified sponsored-partner offers, including offers from Biogen.

Viewing a sponsored offer does not give the partner access to your Diet Different account information. If you choose to open a partner’s website, you leave Diet Different and the third party’s own privacy policy and terms apply.

Diet Different is not responsible for the privacy practices of external websites, restaurants, app stores or other independent third parties.

12. Data retention

We generally retain account information while your account remains active and for as long as reasonably necessary to provide the service.

When an account is permanently deleted, Diet Different removes the active user account and associated user-specific information, including account sessions; saved nutrition goals and calorie and macronutrient targets; meal-planner entries, food quantities and nutritional snapshots; healthy-habit and water-intake records; consistency progress, streaks and earned badges; and progress check-ins, including recorded body weights, body measurements and notes.

Account-deletion form submissions may be retained for as long as reasonably necessary to verify and complete the request and maintain an appropriate compliance record.

Apple, Google, RevenueCat, Wix and other independent providers may retain information according to their own legal obligations and retention policies.

Where providers maintain secure backups, residual information may remain for a limited backup cycle before being overwritten or deleted.

13. Account deletion

You can initiate permanent account deletion inside the App by following:

Profile → Account Settings → Delete Account

If you cannot access the App, you can submit a deletion request at:

We will verify ownership of the account before processing a website request.

Account deletion is permanent. Once completed, the deleted account and information cannot be restored.

Deleting your Diet Different account or uninstalling the App does not cancel an Apple App Store or Google Play subscription. Subscriptions must be cancelled separately through your Apple ID or Google Play subscription settings.

14. Your privacy rights

Subject to applicable law, you may ask us to:

• Confirm whether we hold personal information about you

• Provide access to your personal information

• Correct inaccurate, incomplete, misleading or outdated information

• Delete or destroy information that we are no longer authorised to retain

• Object to certain processing

• Withdraw consent where processing is based on consent

• Explain how your information has been used or shared

• Consider a complaint regarding our handling of your information

We may need to verify your identity before completing a request. We will respond within a reasonable period and in accordance with applicable law.

15. Security

We use reasonable technical and organisational safeguards designed to protect personal information, including secure authentication, access controls, session controls, restricted administrative access, encrypted network connections and security logging.

No electronic service can guarantee complete security. If we become aware of a security compromise involving personal information, we will investigate it and notify affected people and the Information Regulator where required by law.

You are responsible for protecting access to your email account, devices and login verification codes.

16. Automated calculations and progress features

The calorie and nutrition calculators use information you enter to generate automated estimates. Food Library quantities and serving units are also used to calculate estimated nutritional values for foods added to your meal plan.

Weekly progress percentages, trophies, consistency streaks, personal bests and badges are generated automatically from planner and healthy-habit activity recorded through your account.

These calculations and progress features are informational and motivational tools. They do not make legal or similarly significant decisions about you, do not assess your health or compliance with medical advice, and are not a substitute for an individual medical or dietetic assessment.

17. Changes to this Privacy Policy

We may update this Privacy Policy when our services, technology, providers or legal obligations change.

The updated version will be made available in the App and on this website with a revised “Last updated” date. Where a change materially affects how personal information is used, we will provide reasonable notice where required.
